Temporary Resident Permits ( TRP )

Summary:

A Temporary Resident Permit, or a TRP, allows someone who is inadmissible to Canada, to visit Canada, usually for work, family, or emergency reasons. It is like a Temporary Resident Visa (TRV) for those who cannot be issued a TRV or PR due to inadmissibilities such as misrepresentation, medical or criminal reasons.

Who can get a TRP?

A visa or border services officer may issue a TRP to a foreign national if:

  • the need for the foreign national to enter or remain in Canada is compelling
  • the need for the foreign national’s presence in Canada outweighs any risk to Canadians or Canadian society

Can someone inadmissible for criminality receive a TRP?

Yes. In criminal case reviews, officers evaluate the time since sentence completion to determine rehabilitation eligibility or deemed rehabilitation status, placing responsibility on the individual to prove low risk and unlikelihood of reoffending. Assessments cover offence seriousness, reoffence probability, behavioral/medical factors, reform evidence, substance influence, criminal pattern, sentence completion, outstanding charges, travel restrictions, rehabilitation eligibility, and potential risk or controversy by their presence in Canada.

For example, Canada offers Temporary Resident Permits (TRP) to individuals with a criminal record, including DUIs, allowing them entry into the country for a specific period. Applying for a TRP is complex, often requiring extensive paperwork and a persuasive narrative justifying entry. How long is a TRP valid for?

The maximum duration of a TRP is 3 years. But it is usually issued based on the need mentioned in the application, at the discretion of the Visa or Border Services Officer.

Studying or Working with a TRP

You have to apply separately for a Study or a Work Permit. A TRP itself doesn’t allow you to study or work in Canada. You may be issued a study or work permit if you have a TRP that is valid for more than 6 months in duration.

What is the fee for a TRP?

A TRP costs $229.77 CAD.

Where can I apply for a TRP?

You can apply at a visa post, or apply at the port of entry if you are a US citizen or Permanent Residence (US Green Card Holder). It is recommended to apply at the visa post, with proper documentation. As the visa officers are often more experienced and trained at handling TRP applications, compared to CBSA agents at the border.

Documents required for a Temporary Resident Permit

  1. Proof of Identity

    • For non-US citizens: Copy of passport or other travel documents.
    • For US citizens: Copy of passport or birth certificate.
  2. Current Immigration Document

    • Copy of your current Temporary Resident Permit (TRP) and any work or study permit, if applicable.
  3. Supporting Documentation

    • Documents demonstrating any action taken to resolve inadmissibility or non-compliance, such as:
      • Valid passport
      • Improved financial situation evidence
      • Record suspension or approved rehabilitation
      • New Temporary Resident Visa (TRV)
      • Proof of any criminal convictions, if applicable, including the criminal conviction certificate, copy of the statute, official proof of sentence, and FBI criminal record check.
  4. Proof of Financial Support

    • Evidence of financial means to support your stay in Canada and to pay for transportation to leave Canada, such as bank statements or a guarantor’s letter.
  5. Explanation Letter

    • A detailed letter explaining:
      • Why your situation is exceptional
      • Any changes in circumstances since the initial TRP
      • Details of your initial TRP issuance
      • Any new offenses committed since the initial TRP issuance
      • Efforts made to resolve inadmissibility or non-compliance
      • Details surrounding your inadmissibility
  6. Biometric Information

    • As of December 3, 2019, applicants from within Canada must give biometrics. Check if your biometrics are still valid using the Check Biometric Status Tool.
  7. Photographs

    • Two (2) passport-sized photographs for the TRP application.
  8. Application Form

    • Completed and signed Application to Change Conditions, Extend my Stay or Remain in Canada as a Visitor or Temporary Resident Permit Holder (IMM 5708).
  9. Fee Payment Receipt

    • Proof of payment for the application processing fee and biometrics fee, if applicable.
  10. Additional Documents for Family Members

    • If family members are applying with you, each must complete their own set of documents as applicable.
